Defense of Road Construction Company Wins at Summary Judgment Hearing

Jim Thomson, II, prevailed on a motion for summary judgment defending a road construction company against a plaintiff claiming she sustained injuries due to an improperly maintained work site. The construction company successfully argued that the plaintiff could not show the construction company’s conduct fell below the standard of care or any industry standard, nor could the plaintiff show the work site was exclusively controlled by the construction company. As a result, the case against the construction company was dismissed.
